Apply Subclass 190 Visa for Australian Permanent Residence via State Nomination

The Skilled Nominated Visa (Subclass 190) allows foreign nationals who are nominated by the governing agency of an Australian state or territory to permanently live and work in Australia, along with their families. For at least the first two years after arriving, the visa holder is committed to living in the nominating state/territory. Subsequently, they may move anywhere in the country. Aspirants can apply Subclass 190 visa, if they meet criteria for nomination set by the state/territory, and the visa requirements set by the federal immigration authority — the Department of Home Affairs (DHA).

The criteria and application process for nomination differs across all states and territories, and is best understood by seeking the assistance of trained and experienced consultants. On the other hand, the DHA’s Australia PR visa requirements for this state nomination visa are fairly easy to satisfy:

· Be under 45 years of age at the time of being invited to apply for the visa.

· Be nominated by an Australian state/territory. Typically, nomination is issued to immigrants who can meet the local labor market requirements of a state/territory.

· Practice an occupation that is mentioned on the relevant list of skilled occupations for the Subclass 190 visa. This is known as the nominated skilled occupation i.e. the occupation that the immigrant will be practicing in Australia.

· Obtain a positive skills assessment from the relevant assessing authority for the nominated skilled occupation.

· At least have competent English language skills — demonstrated by the results of an approved language examination. Some occupations may require a higher level of English proficiency.

· Score at least 65 Australia immigration points based on various selection factors including age, English language skills, work experience, academic qualifications, adaptability, spouse/partner skills (if applicable), nomination, etc. Obtaining a state nomination for this visa adds 5 points to the total score.

· Meet the DHA’s health and character requirements.

· The applicant or their family members should not have any outstanding debt payable to the Australian government.

· Commit to respecting Australia’s way of life and obeying the law, by signing the Australian Values Statement.

· Not have had a visa cancelled or visa application previously refused while in Australia.

Those who meet these requirements can submit an online Expression of Interest. Each candidate is allocated a point score, and the highest-scoring candidates are invited to apply for the visa. A complete application — including supporting documents and visa fees (AUD 4,045 for the primary applicant) — must be submitted to the DHA, within 60 days of receiving the invitation. Spouse/partner and dependent children can be added to the application.
